Terms of Service -- Indifferent Broccoli (:|)

Terms of Service

These Terms cover your use of indifferent broccoli's game server hosting. By creating an account or a server, you agree to be bound by them. We reserve the right to modify or replace these Terms at any time.

Our Service

We rent out game servers. When you create a server, we run it on our hardware in the region you pick and give you a control panel with full file access to manage it. You choose the game, plan, and settings, and you are responsible for how your server is configured and what runs on it.

Your Account

You need an account to run a server. Keep your login details secure, because you are responsible for everything done through your account, including anything done by subusers you add to your servers. Keep your contact and billing information accurate so we can reach you about your service.

Free Trial

Every game comes with a 2-day free trial, and no credit card is required to start one. To keep your server after the trial, subscribe to a paid plan before it ends. Trial servers that are not upgraded may be stopped and deleted. Trials are meant for trying out the service, so creating multiple accounts to stack free trials is not allowed.

Plans and Pricing

Most plans are priced by player count, not by RAM. Your plan's player count is the maximum number of players who can be connected to your server at the same time. Some games, such as Minecraft and Hytale, are sold by RAM instead, and those plans include the amount of RAM listed on the plan. There are no setup fees, and current prices are shown on each game's page and at checkout.

Uncapped RAM

Plans that list uncapped RAM have no fixed memory limit. Instead of buying a RAM size, your server is scaled to the RAM it needs on host machines with at least 128GB of RAM, and only your player count is limited. Most games take the memory they need on their own, but a few cap it in their own config. Contact support if your game needs that limit raised.

Uncapped RAM Fair Use

Uncapped RAM is for running your game server, including its mods, plugins, and players. Uncapped does not mean a whole machine is reserved for you: the RAM on each host machine is shared fairly across the servers running on it. If a server uses far more memory than its game and player count call for, for example because of a memory leak, a misbehaving mod, or software that is not part of the game, we may restart it, ask you to fix it, or limit its memory until the problem is resolved.

Billing

Each server is billed automatically at the start of every billing term (monthly, quarterly, semi-annual, or annual) to the payment method on your account. Longer terms come with the discount shown at checkout. Payments are processed securely by Stripe and PayPal. Your card details go directly to them, and we only see the card brand and last four digits for identification. If a payment fails, we may suspend your server until it is paid.

Cancellation

You can cancel at any time. Your server stays available until the end of the billing term you have already paid for. After that, your server and its files are deleted, so download a backup from the control panel first if you want to keep your world.

7-Day Refund Policy

New customers are entitled to a full refund during their first 7 days. To request one, contact support. Refunds are not guaranteed for accounts violating these Terms.

Your Server and Data

Your worlds, saves, and configuration files are yours. With full file access you can upload, download, and back them up through the control panel whenever you like. We work to keep your data safe, but hardware can fail and game updates can corrupt saves, so keep your own copy of anything you cannot afford to lose.

Games, Mods, and Third-Party Content

Games are owned by their publishers, and we are not affiliated with them. By running a game server you agree to follow that game's license and server terms, such as the Minecraft EULA. You are responsible for any mods, plugins, maps, or other content you install, including having the right to use them. Game updates are outside our control and can change or break servers, mods, and saves.

Acceptable Use

Your server may only be used to host games. You may not use our service to break the law or host illegal content; attack, scan, or spam other networks or services; mine cryptocurrency or run software that is not part of hosting your game; or interfere with other customers' servers or our infrastructure. We may stop, suspend, or delete servers that break these rules, and close the accounts behind them.

Uptime and Support

We aim to keep your server online around the clock and protect it with DDoS mitigation, but we cannot promise uninterrupted service. Maintenance, hardware failures, network issues, and game updates can all cause downtime. Our team provides human support through tickets on Discord and by email.

No Warranties

This service is provided 'as is' and 'as available', without any warranty, to the fullest extent allowed by law. Service may be interrupted at any time.

Limitation of Liability

To the fullest extent allowed by law, we are not liable for indirect or consequential losses, including lost game progress, lost data, or lost revenue from your server. Our total liability for any claim is limited to the amount you paid us for the affected server during the billing term in which the claim arose.

Changes to These Terms

We may update these Terms from time to time. When we do, we will change the date at the top of this page. Continuing to use the service after an update means you accept the new Terms.
